These Terms and Conditions (“Terms”) govern your access to and use of future-gen.co.za and its content, functionality, and related communications (collectively, the “Website”). The Website is operated by FutureGen Investments (“FutureGen”, “we”, “us” or “our”), an Alzu Group company.
By accessing or using the Website, you agree to be bound by these Terms. If you do not agree, you must stop using the Website. If you use the Website on behalf of an organisation, you represent that you are authorised to accept these Terms for that organisation.
2. About the Website
The Website presents general information about FutureGen, the Alzu Group, our investment approach, team, ecosystem, portfolio interests, news, and related matters. It may also provide contact details through which operators, founders, partners, suppliers, candidates, or other persons can communicate with us.
Website content is provided for general information and discussion purposes. It may be changed, withdrawn, or updated without notice.
3. No offer, solicitation, or commitment
Nothing on the Website constitutes or forms part of:
- an offer, invitation, solicitation, or recommendation to buy, sell, subscribe for, or otherwise deal in any security, financial product, business, or asset;

- it does not contain unlawful, malicious, or harmful content; and
- where it includes another person’s personal information, you have a lawful basis to share it.
Sending a Submission does not create a confidential, fiduciary, advisory, agency, partnership, employment, or other relationship. Unless we have signed a separate confidentiality agreement, you should not send trade secrets or highly sensitive confidential information. We may already be considering, developing, or receiving information concerning similar ideas, businesses, products, or opportunities.
You retain ownership of your Submission. You grant FutureGen and relevant Alzu Group entities a non-exclusive, worldwide, royalty-free licence to receive, store, copy, review, analyse, share internally and with professional advisers, and otherwise use the Submission for evaluating and managing the relevant enquiry, opportunity, relationship, and associated legal or compliance requirements. Our handling of personal information is governed by our Privacy Policy.
9. Intellectual property
The Website and its content – including text, graphics, logos, trade marks, photographs, videos, illustrations, layout, design, software, and other materials – are owned by or licensed to FutureGen, the Alzu Group, or relevant third parties and are protected by intellectual-property laws.
Except for temporary copies automatically made when browsing, you may not copy, reproduce, modify, adapt, translate, distribute, republish, transmit, display, license, sell, exploit, or create derivative works from Website content without prior written permission from the relevant rights holder. No licence or right is granted by implication.

This exclusion includes direct, indirect, incidental, special, consequential, punitive, or economic loss; loss of profit, revenue, opportunity, business, goodwill, reputation, data, or anticipated savings; and loss caused by interruption, error, malware, cyberattack, unauthorised access, or transmission failure, whether arising in contract, delict (including negligence), statute, or otherwise.
Where liability cannot lawfully be excluded, it will be limited to the maximum extent permitted by law. Nothing in these Terms excludes liability for fraud, wilful misconduct, gross negligence to the extent it cannot lawfully be excluded, or any other liability that applicable law prohibits us from excluding or limiting.
14. Indemnity
To the fullest extent permitted by law, you agree to indemnify and hold harmless FutureGen, the Alzu Group, their related entities, and their respective directors, officers, employees, contractors, advisers, and representatives against claims, losses, liabilities, damages, penalties, costs, and reasonable legal expenses arising from your unlawful or prohibited use of the Website, your breach of these Terms, your Submission, or your infringement of another person’s rights.
15. Suspension and termination
We may restrict, suspend, or terminate your access to all or part of the Website if we reasonably believe that you have breached these Terms, created a security or legal risk, interfered with the Website, or acted unlawfully. Rights and obligations that by their nature should continue after termination will survive, including those concerning intellectual property, disclaimers, liability, indemnity, governing law, and disputes.
16. Changes to the Website or these Terms
We may amend these Terms from time to time. The updated version will be published on the Website with a revised effective date. Changes apply from publication unless a later date is stated. Your continued use of the Website after a change takes effect constitutes acceptance of the updated Terms.
17. Governing law and jurisdiction
These Terms and any dispute or non-contractual obligation arising from or connected with the Website are governed by the laws of the Republic of South Africa.
You consent to the jurisdiction of the courts of South Africa. Nothing in this clause prevents either party from seeking urgent or interim relief from a court with competent jurisdiction.
18. General
Entire agreement. These Terms, together with the Privacy Policy and any notices expressly incorporated into them, constitute the agreement between you and FutureGen regarding use of the Website. They do not replace a separate written agreement governing an investment, transaction, service, employment, confidentiality obligation, or other relationship.
Severability. If any provision is found unlawful, invalid, or unenforceable, it will be severed or limited to the minimum extent necessary, and the remaining provisions will continue in effect.
No waiver. A failure or delay in enforcing a right is not a waiver of that right.
Assignment. You may not assign or transfer rights or obligations under these Terms without our prior written consent. We may assign them to an Alzu Group entity or in connection with a reorganisation, financing, sale, merger, or transfer of relevant assets or operations.
Interpretation. Headings are for convenience only. Words such as “including” do not limit the words that precede them. References to law include amendments and replacement legislation.
